I work within the Guidelines of the Privacy Act 1988 Amended 2000. Your Privacy is important to me.
· Minimal records are kept with information noted mainly in your own words. These records are kept to ensure quality of service and accountability. They are kept under lock and key.
However David Nowland’s Duty of Care may override confidentiality in matters relating to child abuse, suicide, homicide and illegal acts.
Confidentiality has limits and David Nowland may be required to disclose information regarding a client under the following circumstances:
· When a court subpoenas client records held by David Nowland.
· When a client or a third party is in imminent risk of harm, David Nowland has a duty of care to ensure the client or third party is safe.
I will endeavour to speak with you where it is practical to do so before releasing such information. If you have any questions or concerns about confidentiality please speak with me before signing below.
Requests for access to client information
You may access the material recorded in your file upon request, subject to the exceptions in National Privacy Principle 6. The request must be serious, i.e. "The request must not be frivolous or vexatious". All requests by clients for access to information held about them should be lodged with David Nowland. These requests will be responded to within 14 days and an appointment may be made if necessary for clarification purposes.
If you have a concern about the management of your personal information, please inform me. If you wish, you can obtain a copy of the National Privacy Principles, which describe your rights and how your information should be handled. Ultimately, if you wish to lodge a formal complaint about the use of, or access to, your personal information, you may do so with the Office of the Federal Privacy Commissioner on 1300 363 992, or GPO Box 5218, Sydney, NSW 1042.
Appointment Reminders - You may be contacted by phone or email for an appointment reminder. If contact is by phone, a recorded message may be left on your answering machine.
Psychologist Cancellation – If for some reason an appointment must be cancelled, you will be contacted by phone or email. If contact is by phone, a recorded message may be left on your answering machine/voicemail.
